1. Acceptance of Terms

By accessing or using FooQR's platform, website, or mobile application, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of the platform immediately. These terms are governed by the laws of India.

2. Eligibility

FooQR's services are available to individuals and businesses who are at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872. By registering, you confirm that you meet these eligibility requirements.

3. Account Registration and Responsibility

You are responsible for maintaining the confidentiality of your account credentials. Any activity performed through your account is your sole responsibility. FooQR will not be liable for any unauthorised access resulting from your failure to protect your login information. Please notify us immediately at hello@fooqr.com if you suspect any breach.

4. Subscription Plans and Billing

FooQR offers both free and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at the time of purchase. All prices are inclusive of applicable taxes unless stated otherwise. FooQR reserves the right to revise pricing with prior notice of at least 30 days to existing subscribers.

5. Refund Policy

Subscription fees paid for monthly plans are non-refundable once the billing cycle has commenced. For annual plans, a pro-rated refund may be issued within 7 days of payment if the service has not been substantially used. Refund requests must be submitted to hello@fooqr.com with your registered email and reason for the request.

6. Acceptable Use

You agree to use FooQR solely for legitimate restaurant, café, hotel, or food business management purposes. You must not use the platform to transmit unlawful, harmful, or fraudulent content. FooQR reserves the right to suspend or terminate any account found in violation of this policy without prior notice.

7. Intellectual Property

All content, technology, branding, and design elements on the FooQR platform are the exclusive intellectual property of FooQR Technology Private Limited. You may not copy, modify, distribute, or reverse-engineer any part of the platform without written permission. Your restaurant's menu content and business data remain your property at all times.

8. Third-Party Integrations

FooQR integrates with third-party services including payment gateways, WhatsApp Business API, and delivery platforms. FooQR is not responsible for the availability, accuracy, or performance of these third-party services. Your use of integrated third-party services is subject to their respective terms and conditions.

9. Limitation of Liability

FooQR shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the platform, including but not limited to loss of revenue, data, or business opportunity. FooQR's total liability in any matter shall not exceed the amount paid by you in the 3 months preceding the claim.

10. Service Availability and Downtime

FooQR strives to maintain 99% platform uptime. However, scheduled maintenance, technical issues, or circumstances beyond our control may result in temporary unavailability. FooQR will make reasonable efforts to notify users in advance of planned maintenance. No refunds will be issued for downtime lasting less than 24 continuous hours.

11. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the platform will cease at the end of the current billing cycle. FooQR reserves the right to terminate accounts that violate these terms immediately and without refund. You may request export of your data within 30 days of termination.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of India. Any disputes arising from the use of FooQR's platform shall first be attempted to be resolved through mutual discussion. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of courts in Indore, Madhya Pradesh, India, in accordance with the Arbitration and Conciliation Act, 1996.
